Quebec’s Automobile Insurance Act

Here is a presentation of some definitions related to car insurance in Quebec that apply to online car insurance as well:

Motor vehicle:

Car, taxi, bus, vintage vehicle, moped, motorcycle, motorcycle, quad, moped, snowplough, snowmobile, farm tractor, ATV, truck and equipment vehicle (loader etc.)

Public road:

All numbered roads as well as logging roads and roads leading to outfitters.

Automobile Accident – Automobile Accident
– caused by loading (in the vehicle or on the vehicle) – caused by a trailer attached to the vehicle.

The T.A.Q. reverses a decision of the SAAQ refusing a claim by the mother of a young girl who died while engaging in car surfing. This refusal alleged that the activity in which she was engaged at the time of the accident was comparable to car surfing, the auditor was of the opinion that it was not an automobile accident within the meaning of the Act since, in this case, the automobile had been diverted from its usual meaning.

On the evening of July 27, 2009, a few young girls were driving on the public road. One of them, sitting on the trunk, was thrown to the ground when the driver accelerated by turning right on a street corner. She suffered a violent traumatic brain injury, never regained consciousness and died four days later. The driver pleaded guilty to dangerous driving causing death under section 249(4) of the Criminal Code.

The T.A.Q. allowed the appeal and recognized the appellant’s right to
the indemnity. Here are his reasons:

The Tribunal must therefore determine whether the event that caused the
an injury to G.D. is an automobile accident that gives rise to a right
for the benefit of the Act. According to the Société, the damage, in order to be covered by the Act, must have been caused by the use of an automobile.

In this case, the Company submits that by using the automobile as a toy, there would have been a misuse of the automobile which would have caused it to lose its classification as an automobile.

In addition, it submits that if the intention in the use of a car is to obtain thrills, it is no longer a normal use of a vehicle.

The concept of “normal” use is not found in any of these provisions of the Act.
