The T.A.Q. overturned a decision by the SAAQ to deny a claim by the mother of a young girl who died while car surfing. The refusal alleged that the activity in which she was engaged at the time of the accident was similar to car surfing, but the reviser was of the opinion that it was not an automobile accident within the meaning of the Act, since in this case the automobile had been diverted from its usual purpose.
On the evening of July 27, 2009, some young girls were out and about on public roads by car. One of them, sitting on the rear trunk, was thrown to the ground when the driver accelerated while turning right at a street corner. She suffered severe brain trauma, never regained consciousness, and died four days later. The driver pleaded guilty to a charge of dangerous driving causing death, under section 249(4) of the Criminal Code.
The T.A.Q. allowed the appeal and recognized the appellant's right to
compensation. Here are his reasons:
The Tribunal must therefore determine whether the event that caused
an injury to G.D. is an automobile accident that entitles
to the benefit of the Act. According to the Company, to be covered by the Act, the injury must have been caused by the use of an automobile.
In this case, the Company submits that by using the car as a toy, the use of the car would have been diverted, causing it to lose its automobile status.
Furthermore, she argues that if the intention when using an automobile is to obtain thrills, it is no longer a normal use of a vehicle.
The notion of "normal" use is not to be found in any of these provisions of the Act.
